1. Acceptance of Terms
By accessing or using DiscoList ("DiscoList", "we", "us", or "our"), including the website at https://discolist.xyz, the DiscoList Discord bot, DiscoLaunch, the server backup system, and all associated features and services (collectively, the "Service"), you agree to be legally bound by these Terms of Service ("Terms").
If you do not agree to these Terms in their entirety, you must not access or use the Service. These Terms apply to all visitors, users, and others who access or use the Service.
We reserve the right to update these Terms at any time. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically.
2. Eligibility
You must be at least 13 years of age to use the Service. Because DiscoList requires a Discord account and Discord's own Terms of Service require users to be at least 13 years old, anyone under the age of 13 is strictly prohibited from using the Service.
If you are between the ages of 13 and 18 (or the age of majority in your jurisdiction), you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. If you are accepting these Terms on behalf of an organisation or entity, you represent and warrant that you have authority to bind that organisation to these Terms.
By using the Service, you represent and warrant that you meet all eligibility requirements and that all information you provide is accurate, current, and complete.
3. Account Registration and Authentication
Access to certain features of the Service requires you to authenticate using a Discord account via Discord's OAuth2 system. By signing in with Discord, you grant DiscoList access to certain data from your Discord account as described in our Privacy Policy.
You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account. You agree to notify us immediately of any unauthorised use of your account. DiscoList is not liable for any loss or damage arising from your failure to maintain account security.
You may not create multiple accounts to circumvent bans, restrictions, or limitations imposed on a previous account. We reserve the right to terminate duplicate accounts.
4. Discord Developer Policy Compliance
DiscoList is an application built on the Discord API and is subject to Discord's Developer Policy and Developer Terms of Service. By using DiscoList, you acknowledge and agree that:
- Your use of DiscoList must comply with Discord's own Terms of Service and Community Guidelines at all times.
- Any Discord server you connect to or list through DiscoList must comply with Discord's Terms of Service and Community Guidelines.
- You will not use DiscoList to circumvent, abuse, or exploit the Discord platform or API in any way.
- DiscoList uses Discord data only to provide the Service to you and not for any other purpose.
- You may revoke DiscoList's access to your Discord account at any time via Discord's Authorized Apps settings.
- DiscoList is an independent service and is not affiliated with, endorsed by, or sponsored by Discord Inc. The word "Discord" and the Discord logo are trademarks of Discord Inc.
5. Server Listings and Discovery
DiscoList allows you to connect Discord servers you own or manage and optionally list them on our public discovery page. By submitting a server listing, you agree to the following:
- You may only connect or list servers for which you are the owner or have been expressly authorised by the owner to represent on DiscoList. You must have Administrator or Manage Server permission on the Discord server.
- All server descriptions, tags, and submitted content must be accurate and not misleading.
- Servers listed on discovery must comply with Discord's Terms of Service and Community Guidelines.
- Servers must not promote, facilitate, or contain: illegal content, NSFW content accessible to minors, hate speech, harassment, discrimination, violence, self-harm, misinformation, spam, phishing, or scams.
- Invite links must be valid. You are responsible for keeping your invite link current. Expired or invalid invite links may result in your listing being removed.
- Server names, descriptions, icons, and tags must be appropriate for a general audience in the context of the discovery listing.
- You may not list the same server multiple times or create duplicate listings.
- We reserve the right to reject, remove, demote, or ban any server listing at any time, at our sole discretion, with or without notice, if we determine that it violates these Terms or is otherwise harmful to our platform or community.
- Servers listed on discovery are subject to an admin review process. Approval is not guaranteed and is at our sole discretion.
6. Server Backups
DiscoList provides a server backup feature that allows you to snapshot and restore your Discord server's structure (roles, channels, categories). By using this feature, you agree that:
- You are solely responsible for ensuring you have the necessary permissions within your Discord server to use the backup and restore commands.
- You acknowledge that restoring a backup may overwrite or delete existing server structure. DiscoList is not responsible for any data loss, disruption, or unintended changes to your Discord server resulting from the use of backup or restore commands.
- Backup data is stored securely on our servers but DiscoList does not guarantee the availability, integrity, or perpetual storage of your backup data. You should maintain your own records where critical.
- You will not use the backup feature to extract, copy, or reproduce server structures that you do not own or have permission to back up.
- DiscoList may impose limits on the number or size of backups per account. We reserve the right to modify, suspend, or terminate the backup feature at any time.
7. DiscoLaunch Templates
DiscoLaunch allows you to deploy pre-built server structure templates to your Discord servers. By using DiscoLaunch, you agree that:
- You may only deploy templates to Discord servers on which you have Administrator or Manage Server permission.
- Deploying a template may create, modify, or (if the wipe option is selected) delete existing channels and roles. You acknowledge and accept full responsibility for any resulting changes to your server structure.
- The "Wipe server before deploying" option permanently deletes all existing channels and roles before applying the template. This action is irreversible. DiscoList is not liable for data loss resulting from use of this feature.
- Templates provided by DiscoList are offered as-is and are intended as a starting point. We make no guarantees about the suitability of any template for your specific use case.
- You may not use DiscoLaunch to deploy templates that would result in a server structure that violates Discord's Terms of Service or Community Guidelines.
- User-created and AI-generated templates must comply with all applicable sections of these Terms. We reserve the right to remove any template that violates these Terms.
8. User-Generated Content
The Service allows you to submit content including server descriptions, reviews, tags, and other text ("User Content"). You retain ownership of your User Content, but by submitting it you grant DiscoList a worldwide, non-exclusive, royalty-free, sublicensable, and transferable licence to use, reproduce, distribute, display, and adapt your User Content in connection with operating and improving the Service.
You represent and warrant that:
- You own or have the necessary rights to submit your User Content.
- Your User Content does not infringe any third-party intellectual property, privacy, or other rights.
- Your User Content does not contain viruses, malware, or harmful code.
- Your User Content is accurate and not misleading.
We reserve the right (but have no obligation) to review, edit, refuse, or remove any User Content at any time and for any reason without notice. We do not endorse any User Content submitted by users.
9. Votes and Reviews
- You may vote for a server once every 12 hours per account. Votes are a measure of community interest and are not endorsements by DiscoList.
- You must not use bots, scripts, fake accounts, coordinated groups, or any other means to artificially inflate or manipulate vote counts. This includes incentivising other users to vote through rewards, giveaways, or similar mechanisms.
- Reviews must be honest, based on genuine experience, and must not be defamatory, abusive, or submitted in bad faith.
- Server owners may not submit reviews for their own servers or solicit fake reviews.
- Violation of voting or review rules may result in removal of votes/reviews, account suspension, and/or server delisting.
10. Prohibited Conduct
You agree not to engage in any of the following activities:
- Violating any applicable local, national, or international law or regulation
- Impersonating any person or entity or falsely representing your affiliation with any person or entity
- Submitting servers, content, or reviews that you do not own or are not authorised to submit
- Using the Service to distribute spam, unsolicited messages, or promotional material
- Scraping, crawling, or systematically downloading data from the Service without our prior written consent
- Using automated tools, bots, or scripts to interact with the Service in a way not explicitly permitted
- Attempting to gain unauthorised access to any part of the Service, other user accounts, or our infrastructure
- Circumventing, disabling, or otherwise interfering with security-related features of the Service
- Attempting to reverse-engineer, decompile, or disassemble any part of the Service
- Interfering with or disrupting the integrity or performance of the Service or the servers and networks connected to it
- Using the Service to harass, abuse, threaten, or harm any person
- Vote manipulation in any form
- Using multiple accounts to circumvent bans or account restrictions
- Listing servers that exist solely for the purpose of farming votes, members, or engagement
11. Intellectual Property
The Service and its original content (excluding User Content), features, design, and functionality are and will remain the exclusive property of DiscoList and its licensors. The DiscoList name, logo, and brand are protected. You may not use our branding without our prior written consent.
Discord server names, icons, descriptions, and other materials submitted by users remain the property of their respective owners. DiscoList does not claim ownership over any third-party content.
If you believe that any content on the Service infringes your intellectual property rights, please contact us with details of the alleged infringement and we will investigate.
12. Moderation, Bans, and Appeals
We reserve the right to moderate all content and accounts on the Service. We may, at our sole discretion and without prior notice:
- Remove or edit any content that violates these Terms or our community standards
- Suspend or permanently ban any user account
- Remove or ban any server listing
- Limit access to certain features
If your server has been banned, you may submit an appeal using the appeal form available on the banned server's dashboard page. Appeals are reviewed at our discretion and we are not obligated to reinstate any banned account or listing. Repeated abuse or serious violations may result in permanent bans without the possibility of appeal.
13. Disclaimers and Limitation of Liability
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND AVAILABILITY.
DiscoList does not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy, completeness, or reliability of any content on the Service.
DiscoList is not responsible for the content, safety, or conduct of any Discord server listed on or linked from the Service. Joining any Discord server through DiscoList is at your own risk.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, DISCOLIST AND ITS OPERATORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, LOSS OF GOODWILL, OR DAMAGE TO PROPERTY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
WHERE LIABILITY CANNOT BE EXCLUDED BY LAW (INCLUDING IN THE EU UNDER CONSUMER PROTECTION RULES), OUR LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.
14. Indemnification
You agree to indemnify, defend, and hold harmless DiscoList and its operators, employees, agents, and licensors from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable legal fees) arising out of or relating to your violation of these Terms or your use of the Service, including but not limited to your User Content, your interactions with other users, or your violation of any law or third-party rights.
15. Termination
You may stop using the Service at any time. You may delete your account from your dashboard settings, which will result in the deletion of your personal data as described in our Privacy Policy.
We may suspend or terminate your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease.
All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability.
16. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with applicable law. If you are a consumer resident in the EU or UK, you benefit from any mandatory provisions of the law of the country in which you are resident, which cannot be derogated from by agreement.
In the event of any dispute arising out of or in connection with these Terms or the Service, the parties agree to attempt to resolve the dispute informally first by contacting us. If the dispute cannot be resolved informally, it shall be subject to the jurisdiction of the relevant courts.
EU residents may also use the EU's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.
17. Severability and Entire Agreement
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and DiscoList with respect to the Service and supersede all prior agreements, representations, and understandings.
